amanpour joins us from rome. this report was in "the observer," the newspaper, saying one man was a 20-year-old seminarien, cardinal was a spiritual director and inappropriate approaches were made after night prayers. what do you know about the case and what cardinal o'brien is saying? >> reporter: well, look, we know according to published reports there's this case and three other cases. a total of four cases now coming out and accusing cardinal o'brien of inappropriate sexual misconduct. he himself is said to have taken up, obviously, legal counsel. he has, as we've said, resigned but he was resigning months ago. it's just that today pope benedict accepted that resignation. he didn't have to accept it today. it could have been further delayed but he did accept the resignation. and now we've also know, because of statements cardinal o'brien has posted, he will not come here to rome and take part in the election of the next pope in the conclave. he said that he would want the spotlight not to be on him but on the pope. but what is clear, suzanne and michael, is that, look, the sun is settin

republicans will finally allow a vote on the nomination of robert bacharach to the u.s. court of appeals for the tenth circuit. because of this filibuster, something that stopped robert bacharach way last year, a man who came out of the senate judiciary committee unanimously, all democrats, all republicans voting for him, the people of oklahoma, colorado, kansas, new mexico, utah and wyoming have been needlessly denied his services as a tenth circuit judge for seven months. now, the judicial vacancies have again risen to almost 90. we have dozens of judges that get blocked for month after month after month, and then the republicans finally allow a vote on it, it passed with 90 votes or 95 votes or 100 votes, but every time that happens, the federal courts have diminished. every time that's happened, aside from the fact that the people of america wonder what in heaven's name we're doing in this body, anything as foolish as that, but the courts, the federal courts are supposed to be so impartial and outside of politics, they appear to be mixed up in politics. how does anybody, from any of

better shape to meet the needs of the banking clients in their community. right now, they are telling us, it is not so much too big to fail. they are worried about the cost of dodd frank, which would involve hiring a staff of people to do the work and they say that the big banks can do that better. we hope that congress would look at that. there are a number of other things in the regulatory area that are bad. if they carry it further, it will make it dangerous for community banks to get any in the game. if congress will look at what the real needs are in the banking sector and and perhaps make it a lot easier for community banks, we certainly would like to see them thrive. it is not, from what i hear, that they are too big to fail. they are too small to compete with regulators. >> take a look at the material -- the gentleman who asked the question -- it begins on page 53 or so of the report or its bills of the scale and the hope that this could reach very deeply into institutions. barry, you had a thought on this question? barry is with the commission and, it is with the consumer federa

've been out there. give us an idea of what they're dealing with. >> it's really cold out there. water conditions right now 50 degrees in the water. what's really dangerous is the rough surf out there. we've got waves at 9.5 feet high and winds are driving the waves relentlessly. a small craft advisory in place which means it's dangerous for those smaller vessels to be out there on the water right now. however, the search from the air actually looking promising because we don't have fog to report this morning. that's the good news. nice and clear out there. the winds have been whipping all night long. the good news in this case is they'll start to drop off heading throughout the afternoon and then overnight tonight in particular. we still have a blustery day to get through. winds at 5 miles an hour in san jose. temperatures are cold to start. 43 in oakland. you want to layer up today. by noon you can peel off that first layer. only thing about today is temperatures are going to be comfortable. a little bit of wind. high clouds streaming in. that's it. just about as perfect as it was ye

in the next two weeks that will point us in the direction for the rest of the year. we'll get numbers on personal income, likely to be down. numbers on big ticket orders, refrigerators, mike waves, tv sets, computers, likely to be down. the service and manufacturing sectors, both expected to be down. consumer sentiment down. and then on the friday of next week, it may be that the unemployment rate goes up to 8% again. all of this because of the taxes that we're imposed on january the 1st, higher gas price, the spending cuts that now look likely, and the threat of even more and higher taxes still to come from the president. it is gas prices are a real problem here. martha: interesting. you're talking about the payroll tax that went up across the board and gas prices going up. it makes you sort of think back to when the president said you can't raise taxes during a recession, a difficult economic period. it didn't make sense. this time they decided they had to do it because they were pushed past the mark last time and didn't want to say they would do it again. >> martha, that was then,
